01Agreement to these terms

These Terms of Service (the “Terms”) govern your access to and use of thericerca (the “Service”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

02What thericerca is

thericerca is a research statistical-analysis platform. You provide a dataset and a description of your study; the Service selects appropriate statistical tests, computes them using established scientific libraries, and produces a report. Statistical results are computed deterministically; any AI assistance is limited to planning and phrasing and does not compute results.

The Service is a tool to assist your analysis. It does not exercise professional judgment on your behalf. You are responsible for the design of your study, the suitability of your data, and the conclusions you draw.

03Your account

You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. Notify us promptly of any unauthorized use. You must be the age of majority in your jurisdiction to use the Service.

04Acceptable use

You agree not to:

• upload data you have no right to use, or that contains others’ personal or sensitive information without a lawful basis and appropriate consent;
• attempt to breach, probe, or circumvent the Service’s security, sandboxing, or access controls;
• use the Service to build a competing product, or to resell access without our written permission;
• overload, disrupt, or reverse-engineer the Service, or use it in violation of any applicable law.

We may suspend accounts that put the Service, its data, or other users at risk.

05Your data and content

You keep ownership of the data you upload and the reports generated from it (“Your Content”). You grant us a limited license to store and process Your Content solely to operate the Service for you — to run the analyses you request, generate your reports, and maintain the Service.

You are responsible for having the rights and lawful basis to upload Your Content and for complying with any laws that apply to it. Our handling of personal data is described in the Privacy & Cookies notice.

06Credits, payments, and refunds

Feasibility assessments are free. Running analyses consumes credits, which you purchase in packs. Payments are processed by our payment provider, Stripe; we do not store your full card details. Prices and pack sizes are shown before purchase.

Credits are consumed when an analysis runs. Except where required by law, purchased credits are non-refundable and non-transferable. If a paid analysis fails for reasons attributable to the Service, the reserved credits are released back to your balance.

07No warranties; not professional advice

The Service is provided “as is” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

08Limitation of liability

To the fullest extent permitted by law, thericerca will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or research outcomes, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the event giving rise to the claim.

09Intellectual property

The Service — its software, statistical engine, design, and brand — is owned by thericerca and its licensors and is protected by law. These Terms grant you no rights to our intellectual property except the limited right to use the Service. Your Content remains yours, as described in Section 5.

10Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or its users. On termination, your right to use the Service ends; sections that by their nature should survive (ownership, disclaimers, liability limits) will survive.

11Changes to the service or terms

We may update the Service and these Terms. When changes are material, we will update the date below and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the revised Terms.

12Governing law

These Terms are governed by the laws of Philippines, without regard to its conflict-of-laws rules. The courts of Philippines will have exclusive jurisdiction over any dispute, unless applicable law grants you the right to bring it elsewhere.
